We are pleased to inform you that Stocznia Remontowa NAUTA S.A. has successfully won two important court cases regarding the termination of annual fees for the perpetual usufruct of property located in Gdynia. As a result of the judgments, the client saved the amount of no less than PLN 4.5 million plus interest.
Attorney-at-law Marcin Deczkowski represented Stocznia Remontowa NAUTA S.A. in both proceedings, from the delivery of the statement on termination of the annual fee in December 2014 to the final resolution of both cases.
As a result of the defence undertaken, in the first of the cases we led to the termination of the annual fee becoming ineffective, i.e. to a situation in which the increase in the annual fee did not occur at all. In this case, the termination of the annual fee was proven to be defective.
In the second case we led to setting the annual fee at the level of approx. 40% in relation to the amount offered by the property owner. In this respect our Law Firm filed a cassation appeal to the Supreme Court, expecting that also in this case the termination of the annual fee will come to an end. The case is pending before the Supreme Court.
It is yet another success of Stocznia Remontowa NAUTA S.A. and the Law Firm in disputes with the State Treasury regarding the amount of the annual fee for perpetual usufruct of real estate.
